This process involves attending sessions where both parties are accompanied by a trained collaborative lawyer. Working with your lawyers, you both try to reach agreement on what you want and how best to settle your differences for the benefit of the whole family as opposed to negotiations taking place through correspondence between solicitors.
You have control of the procedure and work out how to share the assets and responsibilities - for the children for example - as you and your partner each go your separate ways.
You and your collaborative Solicitors sign an agreement which disqualifies them from representing you if the negotiations break down. This means they are absolutely committed to helping you find the best solutions by agreement, rather than through conflict. Other independent and impartial professionals may also be included in the process - in a flexible and neutral way - as and when their support is needed. You set the agenda about the things that matter most to you and your family and maintain contact between you throughout. This all means that you have the best chance of understanding each other and working together in a positive manner to reach an agreed outcome.
The Collaborative Process puts you in control as you and your partner work together, with the support of your Collaboratively trained lawyer, to reach an agreement.
Claire Rutter, Head of Family at Burn & Co is a trained Collaborative lawyer and would be happy to discuss Collaborative Law with you.
At Burn & Co Solicitors we explain everything in plain English, answering any questions you may have and making the process easy to understand. We also offer free, initial over-the-phone advice and will explain the estimated costs and timescales involved as soon as we can so you always know what to expect.

I experienced a firm whose employees knew their job and how to apply its various facets to its clients. I had every confidence in them throughout, which during the course of a case can become a little nerve-racking for the client. Not so for me in this case. So, I thank Burn & Co for their professionalism. I felt secure at every turn and junction in my case. I would, and will, willingly pass their name on to others.
